Please read these Terms of Service (“Terms”, “Agreement”) carefully before using the IslandRide vehicle rental services (the “Service”) operated by IslandRide (“us”, “we”, or “our”).Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.
1. Eligibility and Driver Requirements
1.1. Age Requirement: Renters and all authorized drivers must be at least 18 years of age. Some vehicle categories may have higher age requirements.
1.2. Valid Driver’s License: All renters and authorized drivers must possess a valid, non-probationary driver’s license held for at least one year.
2. Rental Period
2.1. Daily Rate: Rental rates are calculated on a 24-hour basis.
2.2. Grace Period: A typical grace period of [e.g., 59 minutes] may be allowed after the agreed return time. Returning the vehicle after this grace period will result in additional hourly charges or an extra full day’s rental charge, as per the agreed rate.
2.3. Early Return: No refunds will be issued for early returns unless otherwise specified in your rental agreement.
2.4. Extensions: Any extension of the rental period must be authorized by IslandRide prior to the original return time. Unauthorized extensions may result in additional fees and penalties.
3. Vehicle Use and Restrictions
3.1. Authorized Drivers Only: Only the renter and pre-approved authorized drivers listed on the rental agreement are permitted to operate the vehicle.
3.2. Prohibited Uses: The vehicle shall not be used: * For any illegal purpose. * To carry persons or property for hire (unless explicitly authorized and licensed by IslandRide). * To tow or push anything. * In a race, speed test, or contest. * Off-road or on unpaved roads unless explicitly permitted by IslandRide for specific vehicle types. * By anyone under the influence of alcohol, drugs, or any other substance that impairs driving ability. * For driving instruction. * To transport hazardous or flammable materials.
4. Fuel Policy
4.1. Full-to-Full: Unless otherwise specified, vehicles are provided with a full tank of fuel and must be returned with a full tank.
4.2. Refueling Charge: If the vehicle is not returned with a full tank, IslandRide will refuel it and charge the renter for the fuel at a premium rate per gallon/liter, plus a refueling service charge.
5. Maintenance and Condition
5.1. Renter’s Responsibility: The renter is responsible for checking the vehicle’s fluid levels, tire pressure, and other basic maintenance during the rental period and reporting any issues immediately to IslandRide.
5.2. Damages: The renter is responsible for all damages to the vehicle, including but not limited to body damage, mechanical damage, tire damage, and interior damage, that occur during the rental period, regardless of fault.
5.3. Reporting Accidents/Breakdowns: In case of an accident, breakdown, or mechanical issue, the renter must immediately notify IslandRide and follow our instructions. Do not attempt repairs without our explicit consent.
6. Insurance and Liability
6.1. Renter’s Responsibility: The renter is primarily responsible for all damages to the rental vehicle, third-party liability, and any personal injuries incurred during the rental period, up to the full value of the vehicle and beyond, as permitted by law. 6.2.
6.1. Security Deposit: A security deposit will be authorized on your credit card at the time of rental. This deposit will be released upon the safe and timely return of the vehicle in its original condition, subject to any deductions for damages, fuel, or other charges.
7. Payments and Fees
7.1. Rental Charges: All rental charges, including but not limited to the daily rate, mileage charges (if applicable), fuel charges, insurance/waiver fees, additional driver fees, surcharges, and taxes, will be clearly itemized.
7.2. Tolls and Fines: The renter is responsible for all tolls, parking tickets, traffic violations, and any other fines incurred during the rental period. An administrative fee may be charged by IslandRide for processing such violations.
8. Cancellation Policy
8.1. Standard Policy: [e.g., Cancellations made more than 48 hours prior to the scheduled pick-up time will receive a full refund. Cancellations made within 48 hours of pick-up may incur a one-day rental charge or a cancellation fee.]
8.2. No-Shows: Failure to pick up the vehicle at the scheduled time without prior notification may result in the forfeiture of any pre-payment and the cancellation of your reservation.
9. Lost and Found
9.1. IslandRide is not responsible for any personal belongings left in the rental vehicle. While we will make reasonable efforts to return lost items if found, we are not liable for their loss or damage.
10. Termination of Rental
10.1. IslandRide reserves the right to terminate the rental agreement and repossess the vehicle at any time without notice if the renter is found to be in breach of these Terms of Service.
11. Privacy Policy
11.1. Your use of our Service is also governed by our Privacy Policy, which outlines how we collect, use, and disclose your personal information. Please review our Privacy Policy.
12. Limitation of Liability
12.1. To the maximum extent permitted by applicable law, in no event shall IslandRide, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
13. Governing Law
13.1. These Terms shall be governed and construed in accordance with the laws of Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law provisions.
14. Changes to Terms
14.1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
14.2. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
